Terms of Service

1. Acceptance of Terms
By accessing and using the Rochi Agent Platform ("Service"), provided by Rochi Tech LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Rochi Agent, provided by Rochi Tech LLC, provides a suite of hosted real estate tools including, but not limited to, professional website hosting, IDX property data integration, CRM tools, ISA (Inside Sales Assistant) lead engagement, and map-based search functionality.
3. Account Responsibilities
You are responsible for maintaining the security of your account and password. You are also responsible for all content posted and activity that occurs under your account, including compliance with all real estate advertising laws and regulations.
4. Subscription & Billing
The Service is billed in advance on a monthly or annual basis. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
5. Cancellation & Domain Policy
You are solely responsible for properly canceling your account. You can cancel your subscription at any time from your dashboard.
Free Domain Policy: If your subscription includes a free domain name registration (Annual Plans) and you cancel your subscription within the refund window, the standard list price of the domain registration (currently $20.00 USD) is non-refundable and will be deducted from any refund amount. You retain ownership of the domain and may transfer it to another registrar after the ICANN-mandated 60-day lock period.
6. RMLS Data & Compliance
You acknowledge that you must maintain an active membership with RMLS to display listing data. We are not responsible for data feed interruptions caused by your loss of good standing with the MLS. All users must comply with RMLS rules regarding data display and lead generation.
7. SMS Terms & Conditions
By opting into the Rochi Agent SMS program via our web forms, you agree to receive text messages from Rochi Tech LLC.
- Program Description: We send account alerts, technical support updates, and new lead notifications.
- Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to our number. After you send "STOP", we will send a confirmation message.
- Support: For help, text "HELP" or contact us at support@rochiagent.com.
- Liability: Carriers are not liable for delayed or undelivered messages.
- Costs: Message and data rates may apply. Message frequency varies based on your account activity and requested notifications.
8. Limitation of Liability
Rochi Tech LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
9. Fair Use & Usage Limits
To ensure system stability and fair pricing for all users, the Service is subject to the following Fair Use limits:
- ISA Management: The base plan includes management of up to 200 "New Lead" engagements per calendar month. Engagements exceeding this amount may incur an additional fee of $0.50 per lead or require a plan upgrade.
- Map Rendering: The Service includes up to 10,000 map loads per month. This is sufficient for the vast majority of professional real estate use cases. If your site exceeds this volume (e.g., due to high-volume paid advertising campaigns), we may require you to provide your own Mapbox API key to maintain service or bill for overages at $7.00 per 1,000 additional loads.
- Reasonable Usage: Rochi Tech LLC reserves the right to review accounts that exceed 200% of average user benchmarks and may adjust pricing or service levels with 30 days' notice to protect platform integrity.
